Can I dock an exempt employee’s pay?

An exempt employee must be paid his full salary every week in which he works with the following exceptions:

  • The first week he works if it is not a complete week
  • The last week he works if it is not a complete week
  • Any week in which he takes FMLA time
    • If not made whole by vacation or sick time
  • A week in which he takes an entire work day off
    • That was not covered by vacation, personal or PTO time
  • A week in which he takes a full sick day and he either
    • Was not eligible for sick/PTO time under your company’s policy
    • Had exceeded sick/PTO time under your company’s policy
  • A week in which he was suspended for a major safety violation
